Sierra Leone's High Court Impugns Irregularly Obtained Order against African Minerals

Even as a certain local tabloid was busy publishing an irregularly obtained and thus unlawful High Court Order that had been long since ordered discarded by Hon. Justice Ademusu, the Lawyer for African Minerals, C.C.V. Taylor Esq. was in receipt of a letter from Lawyer Jenkins Johnston (Snr.) begging for patience to be exercised by African Minerals and other such clients that he had matters with at the Courts.

In November 2009, Lawyer Jenkins Johnston had obtained through irregular means, a High Court Order against African Minerals Tonkolili Iron Ore (SL) Ltd. Subsequent to this, African Minerals in that same November, had informed the Courts of the highly irregular manner in which the order had been obtained.

"We cannot use the word negligence or deliberate fraud on the part of the Judiciary or the Master & Registrar of the High Court but what is certain is that the order was irregularly obtained and had thus been thrown away and set aside," a source who is familiar with the matter intimated this newspaper adding that it was thus "very unfortunate" for anyone to go ahead and mislead or incite the naive Publisher of the said local tabloid into "disgracing himself with the publication of a highly impugned and discarded High Court Order".

Meanwhile, investigations by this newspaper reveals that the published High Court Order was obtained via administrative dealings between Lawyer Jenkins Johnston and the Masters office; which dealings had failed to take into cognisance the fact that Lawyer C.C.V. Taylor had already entered in an appearance within time. The impugned Default Judgment that was then delivered in the face of the appearance of Taylor thus made a complete nonsense of the Judiciarys Masters Office.

Within a short while of the application to set aside the judgement, last November, Justice Ademusu had approved it and ordered the Judgment to be thrown out. It was this discarded and impugned judgment and accompanying impugned letter from Jenkins Johnston that the local tabloid published thus wittingly or unwittingly making total fools of themselves in their zestful efforts to defame one of the countrys most promising international investors.

African Minerals, which is all set to defend the allegedly frivolous lawsuit, now has to contend with the same Lawyer Jenkins Johnston writing to beg the Chief Justice and lawyers to exercise patience with him as he was currently indisposed to proceed with matters. Thus, the expected summons for directions that should have taken the matter to trial cannot proceed as Jenkins Johnston is begging African Minerals to be patient with his indisposition. Despite all of this, the local tabloid has proceeded to make a fool of itself with the publication of a discarded High Court Order and letter from Jenkins-Johnston which latter learned gentleman is now begging African Minerals for understanding.

When Awareness Times contacted Lawyer C.C.V. Taylor on the issue, he however declined to comment until he first read the local tabloids article.
