In Sierra Leone, JSDP Starts National Legal Aid Scheme

The Government of Sierra Leone in collaboration with the Justice Sector Development Programmed officially launched the National Legal Aid Scheme at the British Council Hall at Tower Hill in Freetown, on Thursday the 22nd April 2010.

While delivering his opening remarks, the Chairman of the ceremony, Hon. Justice Nicolas Brown-Marke mentioned that the Scheme is timely; more especially when the country is about to celebrate its 49th Independence Anniversary. According to him there is no civilized nation where accused persons do not have rights to legal assistance. Sierras Leone being a civilized nation too with a pledge of unity, freedom, and justice, Justice Brown-Marke stressed makes it imperative for Government and other development partners to provide accused persons with legal assistance when and where ever needed.

He further went on to say that accused persons are constitutionally entitled to legal assistance that is supposed to be paid for by the government. He proffered that in modern times, governments must pay attention to people who are in conflict with the law but have no one to represent them in court.

The Hon. Chief Justice, Umu H. Tejan- Jalloh in her own contribution advanced that Legal Aid is part of democratic governance.

"We cannot talk of access to justice, equality before the law, and other democratic principles if the majority of our people are deprived of legal representation in our courts. Sierra Leone has had a turbulent recent past, our socio-economic history has resulted in us being placed at the bottom of economic indicators, and the majority of our people therefore cannot afford legal representation", she said, and further went on that it could not be denied that a large number of people are in prison because they cannot afford lawyers which make them to consequently lose their properties, dignity, and other sources of survival.

Therefore Legal Aid she said is going to parallel Sierra Leones justice system to other advanced democratic countries.

The Attorney General and Minister of Justice, Mr. Serry- Kamal in his statement said that there is a need to accelerate trials so that backlog of case files could be reduced and slash the number of people in detention. According to him Section 28(5) of the Sierra Leone Constitution calls for the provision of legal aid to poor people. Its application since January 2010 has permitted a 10% increase in the release and discharge of accused persons.

The Director of National Legal Aid Scheme, Mrs. Ida Lisk expressed her satisfaction over the commencement of the project and assured that she and her team will work to see justice prevail in the country.
