Summary of Evidence Submitted does not support Indictment of Haja Afsatu Kabba

Freetown, March 16, 2010 (One Year ago): Count 1 and Count 2 of the Anti-Corruption Commissions 17-count indictment against Haja Afsatu Kabba are identical in nature to Count 9 and Count 10. They all reference a $3,000 dollars allegedly solicited and collected by Madam Lilian Lisk from her Chinese Business partners to allegedly bribe erstwhile Fisheries Minister Afsatu Olayinka Kabba to license Chinese boats. Well, one might be tempted to assume that there are two separate incidents of $3,000 allegations but the SUMMARY OF EVIDENCE submitted does not support this.


Indeed, the SUMMARY OF EVIDENCE cites several amounts of such alleged bribes collected by Lilian Lisk but there is only one instance of a $3,000 which leaves the obvious question of whether or not the duplicitous appearance (Count 1 is identical to Count 9 whilst Count 2 is identical to Count 10) was not a shoddy job done in haste, for whatever reason, by persons at the Anti Corruption Commission who urgently wanted to see Hon. Haja Afsatu Kabba removed from office immediately on that very same Monday of yesterday.


It is a fact that the Indictment itself is dated as 12th March but when legal-minded persons searched the Court Records, it was clearly seen that the Master & Registrar only received the Indictment for filing on the morning of March 15th and it was only on that same date that he sent it for the attention of the Honourable Chief Justice Umu Hawa Tejan-Jalloh and again it was only on that same morning that the Chief Justices red-inked signature is seen as having assigned the file to Justice Browne-Marke.


So, whilst the impression of several procedural days is being given [12th to 15th March], the truth of the matter is that the indictment was most hurriedly filed in the morning of March 15th 2010 and again immediately acted upon on that same Monday morning with the ACC also simultaneously dragging the Minister to the Courts even before she had finished being interrogated at the Anti Corruption Commission!


Why this indecent haste to the extent of even abruptly interjecting into the interrogation process and why the entire process was hurriedly done is open to debate especially in light of last weekends discovery of the height of criminality by Madam Lilian Lisks boat mafia-men from China. This is all debatable but what is however indisputable is that in the process of hurriedly preparing the indictment, the drafters reproduced Count 1 and Count 2 in duplicity as Count 9 and Count 10.
Was it because a 15-count charge (frivolous or not) was not as intimidating as a 17-count charge? Only the ACC Commissioner who inexplicably appended his signature to such a shoddy, duplicitous indictment will be able to give us the answer! But since ACC Commissioner is now reported over the BBC to be arrogantly shrugging off concerns raised by citizen taxpayers and since the Parliamentary Committee on Transparency & Accountability seems to be too impotent to handle a bullying ACC Commissioner gone on the rampage and since Western diplomats are now applauding appalling abuse of office and highhandedness of ACC Commissioner which they would frown upon in England or America, well, all we can say is: May God help us all in Sierra Leone! Someone say Amen!


Ladies & Gentlemen, I am looking forward to the arguments about the duplicitous Counts 1, 2, 9 and 10 at the next arraignment of Hon. Haja Afsatu Kabba..!


YEAR 2011 EDITORS NOTE:
There was no next arraignment as the 17 Counts were later either laid on file or the accused was acquitted and discharged of the bogus charges.
