Press Release

 

The Political Parties Registration Commission (PPRC) notes with dissatisfaction comments made against the commission by Chernor Bah, Spokesman of the National Democratic Alliance (NDA) in a radio interview granted by the Cotton Tree News on Monday 15th August 2011. In that interview monitored by PPRC, Mr. Chernor Bah insinuated otherwise that the Commissions action to issue the 21 days notice on the deregistration of dormant political parties including NDA was prompted or influenced by some authority. 

 

The Commission wishes to seize the opportunity to remind the public and all political parties that Section 34 (5) of the 1991 Constitution of Sierra Leone guarantees the operational independence of the Commission.   

 

The PPRC wishes to remind all political parties and the public that on the 29th June, 2011 all registered political parties on record were invited to a meeting. This was with the view to discuss steps taken by parties to regularize their status as required by law.

Subsequent to that, a public notice was issued on 7th July urging all political parties to be in compliance with the Political Parties Act and in particular part IV of the Act. This was directed at all dormant political parties including NDA. Prior to this in November 2010, the commission put out a Press Release reminding Political Parties of the responsibility in fulfilling Part 4 of the Political Parties Act of 2002

 

The Commission wishes to reiterate and confirm that on the expiration of the twenty-one days notice issued on 8th August, 2011, it shall file a motion with the Supreme Court of Sierra Leone to deregister dormant political parties.    

 

In lieu of the above, the Commission with immediate warns Mr. Bah to desist forthwith from such act.

 

The Commission wants Mr. Bah to know that the commission is independent as stipulated in Part 2 Section 7(2) of the Political Parties Act of 2001 which states Except as otherwise provided in the Constitution and this Act, in the performance of its functions, the Commission shall not be subject to the direction or control of any person or authority.

 

The Commission also wants Mr. Bah to know that such statements is interpreted as a ploy to willfully obstruct the  commission in the discharge of its functions as states in Part 2 Section (10) of the Political Parties Act of 2002 which states: Any person who willfully obstruct or otherwise interferes with the Commission or its members or officers in the discharge of the functions of the Commission under this Act, commits an offence and shall be liable on conviction to a fine not exceeding Le 500,000 or a term of imprisonment not exceeding one year or , to both such fine and imprisonment.


The commission wants Mr. Bah to also know that the commission views such statement as contradiction of Part 5 of the Public Order Act of 1965.


The commission wants Mr. Bah to also know that if this continues, the Commission will take up legal actions against Mr. Bah.
