1.That this Honourable Court varies its first order in Order of 14th July 2011 by now granting leave to the plaintiffs to serve Notice of the Concurrent Originating Summons in this matter by way of substituted service on the 1st defendant by one publication each of the said Notice of the Concurrent Originating Summons in the "Awareness Times" Newspaper in Sierra Leone and the "Times" Newspaper in the United Kingdom, and that a copy of this Order and of the other Orders previously made in this Action shall be published in like manner and shall also constitute service on the 1st Defendant.

2.That this Honourable Court consequentially varies it second Order in the Order of 14th July 2011 and now Orders that the 1st defendant if he so desires, enter an appearance to the Originating Summons in this matter, within ten (10) days from the date of the last publication in Sierra Leone or the United Kingdom, which ever comes last.

3.That the third, fourth and fifth orders of the Order of 14th July 2011 shall remain the same.

4.That the Costs of this Application shall be paid by the 1st Defendant, such costs to be taxed.

2.The 1st Defendant shall enter appearance to the Originating Summons within 30 days of the 2nd publication of the Originating Summons in the Awareness Times Newspaper, and of the 2nd Publication in anyone of the three newspapers published in the United Kingdom.

3.The 1st Defendant shall, if he so desires, not more than 10 days after appearance entered, file an affidavit in opposition to the reliefs sought in the Plaintiffsf Originating Summons.

4. The Costs of this Application shall be borne by the 1st Defendant in any event.

TAKE NOTICE that Paramount Chief Amara J. G. Sama (V), Chiefdom Speaker Alhaji Sheku V. Kanneh (Suing as Custodians and or Trustees) for and on behalf of the Chiefdom Council and People of Tunkia AkA Tonkia Chiefdom, Kenema District in the Eastern Province of the Republic of Sierra Leone have commenced an action against you in the High Court of Sierra Leone by an Originating Summons dated the 6th day of Jun 2011, which Originating Summons is endorsed as follows:-

1).Whether the lease agreement dated 20th December 2010 expressed to be made from the Paramount Chief and Chiefdom Council Tunkia Chiefdom Kenema District to Steven Cosser and registered as No. 275/2010 in Volume 105 of Page 89 in the Records Book of Leases kept in the Office of the Registrar General is void for failure to comply with the provisions of The Survey Act Cap 128 of the Laws of Sierra Leone 1960 as amended by Section (2) of Act No. 14 of 1960 The Survey Amendment Act in that the survey plan attached to the said lease was not prepared and signed by a licensed surveyor nor was it counter signed by the Director of Surveys and Lands as required by the provisions of the said Act i.e.

(15)(1) A licensed surveyor who shall prepare any plan to be used in connection with any instrument which is required to be registered under the provisions of the Registration of Instruments Act shall submit the original plan and a copy thereof signed by himself to the Director of Surveys and Lands for scrutiny and for his counter-signature, together with such information as may be required by the Director of Surveys and lands

(15)(2) On receipt of any such plan the Director of Surveys and Lands shall cause the plan to be checked and

(a) if that plan is not found to be incorrect the Director of Surveys and Lands shall certify on the plan that such plan has been checked

(b) if that plan is found to be incorrect the Director of Surveys and Lands shall not so certify on the plan

And in either such case shall return the plan to the licensed surveyor form whom it was received.

(15)(3) No instrument to which is attached any uncertified plan, made after the commencement of this section, shall be registered under the Registration of Instruments Act.

2). Whether the lease agreement dated 20th December 2010 expressed to be made from the Paramount Chief and Chiefdom Council Tunkia Chiefdom Kenema District to Steven Cosser and registered as No. 275/2010 in Volume 105 of Page 89 in the Records Book of Leases kept in the Office of the Registrar General is void for failure to comply with the provisions of The Illiterates Protection Act Cap 104 of the Laws of Sierra Leone 1960 in that the mark of the Chiefdom Speaker by way of his thumb print was not accompanied by an illiteracy protection clause and or certificate as required by the provisions of the said Act i.e.

(2) Any person who shall write any letter or other document for, or at the request, on behalf, or in the name, or any illiterate person, or to be in any way signed or executed by any illiterate person, shall also write on such letter or other document his own name as the writer thereof and his full and true address, and his so doing shall be taken to be the equivalent to a statement that he was instructed to write such letter or document by the person for whom it purports to have been written, and that the letter or document fully and correctly represents his instructions, and that prior to it being signed, by mark or otherwise, it was read over and explained to the person whose mark or signature it bears, and that such mark or signature is the true mark of signature of the person whose mark or signature it purports to be.

3).Whether the lease agreement dated 20th December 2010 expressed to be made from the Paramount Chief and Chiefdom Council Tunkia Chiefdom Kenema District to Steven Cosser and registered as No. 275/2010 in Volume 105 of Page 89 in the Records Book of Leases kept in the Office of the Registrar General is void by reason of the fact that at the time of the execution of the said purported lease, there was in existence a lease dated 16th day of June 2008 expressed to be made from the Paramount Chief and Chiefdom Council Tunkia Chiefdom Kenema District to Jacob Barnett and registered as No. 86/2008 in Volume 101 of Page 114 in the Records Book of Leases kept in the Office of the Registrar General in respect of the same piece and or parcel of land without the prior lease being first cancelled, revoked, discharged or otherwise avoided.

4).Whether the lease agreement dated 20th December 2010 expressed to be made from the Paramount Chief and Chiefdom Council Tunkia Chiefdom Kenema District to Steven Cosser and registered as No. 275/2010 in Volume 105 of Page 89 in the Records Book of Leases kept in the Office of the Registrar General is voidable for failure to comply with the provisions of (A)Section (9)(c) and (9)(d) respectively of The Provinces Land Act of the Laws of Sierra Leone 1960 as amended as well as (B) Rule (3)(d) and (3)(f) respectively i.e.

" Every deed creating a tenancy of land shall be voidable by either party, unless it (c) provides that the lessee shall not sublet or assign his interest thereunder except with the consent of the Tribal Authority with the approval in writing of the District Commissioner, provided that such consent shall not be unreasonably withheld and (d) contains stipulations with regard to all the matters set out in Rule (3) to the Schedule to this Act i.e. Cap 122.

Rule (3) of the Schedule of the Act states that "Every lease required by this Act to be by Deed shall state ............... (d) whether the interest is assignable ................ (f) in cases where the lease is for a longer period than seven years, that the rent is subject to revision every seven years by the District Commissioner subject to right of appeal to the Provincial Commissioner"

If the answer(s) to any of Questions (1), (2), (3) and (4) above is are in the affirmative the plaintiffs seek the following reliefs and or orders

1). A declaration that the lease agreement dated 20th December 2010 expressed to be made from the Paramount Chief and Chiefdom Council Tunkia Chiefdom Kenema District to Steven Cosser and registered as No. 275/2010 in Volume 105 of Page 89 in the Records Book of Leases kept in the Office of the Registrar General is void.

2). An Order by the Honourable Court directed to the 2nd defendant for the delivery up and cancelling of Lease agreement, Instruments, Plan and other documents dated 20th December 2010 expressed to be made from the Paramount Chief and Chiefdom Council Tunkia Chiefdom Kenema District to Steven Cosser and registered as No. 275/2010 in Volume 105 of Page 89 in the Records Book of Leases kept in the Office of the Registrar, and consequential orders for expunging and rectification of all appropriate registers kept at Office of the Registrar General, Roxy Building, Freetown.

3). That the Costs of the application be borne by the Defendants.

4).Any further or other Order(s) that this Honourable Court may deem fit and just.

If the 1st Defendant do not enter an appearance within 30 days, such judgment may be given or Order made against or in relation to him as the court may think just and expedient.

Counsel is to note that I have said in any way and I mean just that as I do acknowledge that the 1st Defendant resides out of the jurisdiction but could deal with the land without entering same.

UPON READING THE NOTICE OF MOTION dated the 13th of July 2011 and the Affidavit in Support of CENTUS MACAULEY ESQ. also sworn to on the 13th of July 2011 in support thereof together with Exhibit attached thereto.

AND UPON HEARING CENTUS MACAULEY ESQ. of counsel for the Plaintiff/Applicant.

IT IS THIS DAY ORDERED AS FOLLOWS:-

I ORDER in the interests of justice and to maintain the status quo:

1.) The Defendant is restrained from dealing in any way whether by transfer, sub-lease, assignment, mortgage with the lands described and defined in Lease dated 20th December 2010 and duly registered as No. 275/2010 at page 89 in volume 89 of the Record Books of Leases kept in the Office of the Registrar General Freetown UNTIL FURTHER ORDER.

2.) UNTIL FURTHER ORDER, no activity of any sort shall be carried on by the 1st defendant, by himself, an/or by his servants or agents or assignees, and all operations,

by virtue of, or under the said Lease are hereby suspended. Any interest which the 1st defendant shall claim to be entitled to under the said Lease shall be suspended until further Order.

3.) The plaintiff shall in the interim retain possession of the said lands until this Court determines the person or persons entitled to possession of the same.

4.) The Sheriff of the Republic of Sierra Leone is authorized to render all necessary assistance necessary to ensure that the Orders made herein are carried out

5.) Liberty to Apply.
