Defence stalls Cross-Examination of Witness in Murder Hearing of Accused Murderers of late Pharmacist Johnson

Defence Lawyer, Melon Nicol has on Tuesday, 15th January 2013 abruptly had to suspend his cross-examination of Prosecution Witness (PW2), Aiah Senesie on the matter between the State versus Olakeh Olive Johnson and seven others in the ongoing murder hearing for the late university lecturer and pharmacists president, Adeyemi Justin Patrick Johnson. The matter is being heard by Principal Magistrate Komba Kamanda of Court No 2.

 

During cross examination, PW2 Aiah Senesie told the court that he was a car dealer, adding that, he knew the second accused through a business transaction for the rental of a red Pathfinder vehicle. He told the court that, he facilitated the rental of the vehicle for a couple from overseas. He added that the couple did not, at anytime, intend to buy the said vehicle but that the second accused, Omar Majid Eustace Cole told him he wanted to sell the car and that since then they had no further discussion on the red Pathfinder.


PW2 further said the second accused told him sometime in October last year that he wanted to sell the car. He said he cannot tell if the car was sold.According to him, he was given his commission for facilitating the rental of the said vehicle. The witness further told the court that he knew that particular vehicle belongs to the first accused, Olakeh Olive Johnson.

 

At this point Defence Lawyer Nicol-Wilson applied for statements of PW2 and other witnesses to be made available to the Defence. He told the court that, he made his application pursuant to certain sections of the Criminal Procedure Act which he listed.

 

The Magistrate however told the Defence Counsel that the sections he quoted for the statement to be made available to him were the wrong ones. The learned magistrate advised the lawyer to do better research and re-apply under the proper section.

 

The humbled defence lawyer subsequently pleaded for the Magistrate to adjourn the matter for further cross examination.

 

The matter was then adjourned to 22nd January this year when it is expected that the learned lawyer will have done better research as instructed by the learned Magistrate and re-apply for the Witness Statements but this time, under the correct section of the Criminal Procedure Act.
