GOVERNMENT PUBLIC NOTICE

MINISTRY OF LANDS, COUNTRY PLANNING AND THE ENVIRONMENT

 

9th May, 2013

 

The Ministry of Lands, Country Planning and the Environment has observed with grave concern, assertions made by Mr. Charles Margai on right of ownership of State Land situate, lying and being at Off Cape Road, Aberdeen, Freetown.  Mr.  Margai has been misinforming the public about his right of ownership through some media houses and making inciting statements and utterances thereby undermining state security.

 

 

The Ministry of Lands, Country Planning and the Environment wishes to emphatically state that the land in question is and has always been property of the Government of Sierra Leone.

 

 

A thorough investigation carried out by the Ministry and records obtained reveal the following facts:-

 

(1) The allegation of Government offering Mr. Ibrahim Abdul Hussein Basma (Deceased) 3.2099 acres of land at Cape Road, Aberdeen, in exchange for another piece of land measuring three town lots, allegedly belonging to him at Spur Loop is fallacious and inconceivable.

In addition, Mr. Ibrahim Basma (deceased), could produce no evidence whatsoever, to substantiate his claim of title to the said land at Spur Loop.

 

 

(2) That Dr. Bobson Sesay, the then Minister of Lands and Country Planning, having been consulted in the course of an earlier investigation into the matter, admitted in a letter dated 15th May 2007, addressed to former President Dr. Ahmad Tejan Kabbah, that Mr. Ibrahim Basmas claim to the said land was spurious and baseless, and that he had signed the forwarded draft conveyance on the directive and for reasons stated in a Memorandum emanating from an Officer in the Law Officers Department, acting on behalf of the then Solicitor, which turned out not to be true.

 

 

(3) That while a copy of the said purported Deed of Conveyance referred to above was deposited for registration at the Office of the Administrator and Registrar General, it did not satisfy Section 11 of the Registration of Instruments Act [Cap. 256 of the Laws of Sierra Leone], and was treated as a reject as evidenced by the fact that it does not bear the signature of the Administrator and Registrar General. The said purported Deed of Conveyance could not have therefore conferred title as stated therein.

 

 

There is abundance of evidence that the piece or parcel of land situate at Off Cape Road Aberdeen measuring 3.2099 acres is and remains to be, State Land.

 

 

In view of the above, Mr. Charles Margai is strictly warned to desist forthwith, from laying any claim whatsoever, to the said land. The Government can no longer stand by, and allow anyone to lay claim to, or interfere with, in any manner whatsoever, the said piece or parcel of land situate lying and being at Off Cape Road, Aberdeen, Greater Freetown.
