Soliciting an advantage contrary to Section 28 (2) (a) of the Anti-Corruption Act 2008

PARTICULARS OF OFFENCE
AFSATU OLAYINKA EBISHOLA KABBA on a date unknown between June 2009 and October 2009 at Freetown, in the Western Area of Sierra Leone, being the Minister of Fisheries and Marine Resources and a Public Officer, solicited an advantage, to wit: the sum of Three Thousand United States Dollars (US$3,000.00) from Lilian Ada Lisk of Okeky Fishing Agency as an inducement for performing an act in her capacity as a Public Officer to wit: the issuance of licenses for fishing boats operated by the said Okeky Fishing Agency.

SUMMARY OF EVIDENCE SUBMITTED BY THE ACC

IN THE HIGH COURT OF SIERRA LEONE HOLDEN AT FREETOWN

THE STATE VS AFSATU OLAYINKA EBISHOLA KABBA And PAUL SANDI

1. LILIAN ADA LISK: will state inter alia that she is a businesswoman operating a joint venture business with China National Fisheries Company (C.N.F.C) under the nomenclature Okeky Fishing Agencies. She will also state that she had been under pressure from AFSATU KABBA whom she had known sometime in 2008 when she was Minister of Energy and Water Resources.

2. That on the strength of their relationship, she had offered accommodation and access to the use of her vehicles to AFSATU KABBA while AFSATU KABBA was on official trips to Ghana. Their relationship however deteriorated because AFSATU KABBA constantly solicited monies from her on an almost monthly basis.

3. That shortly after she was appointed Minister of Fisheries and Marine Resources, AFSATU KABBA visited her at her 4 Damba Road Residence asking for advice on how to make money using her position as Minister of the said Ministry.

4. That she advised AFSATU KABBA to be very careful, as she would be dealing with international people who might expose her attempts to extort money from them.

5. THAT AFSATU KABBA demanded ten thousand United States dollars instead of five thousand because according to her, Okeky Fisheries Agency owned many fishing vessels as compared to the others.

6. That on the 1st July 2009, in the presence of EPHRAIM AYIM, she gave AFSATU KABBA the sum of Twelve Thousand United States Dollars because the Minister had asked her to increase the money from Ten to Twelve Thousand United States Dollars. She counted the money and enclosed same in a brown envelope before handing over to AFSATU KABBA.

7. That she signed a receipt for the sum of Twelve Thousand United States Dollars (USD12000) received from CNFC inorder to satisfy the demands of AFSATU KABBA on or around 1/7/09.

8. That she also signed for and received the sum of Three Thousand United States Dollars (USD3000) on or around 22/6/09 and the sum of Ten Thousand United States Dollars on or around the 26/8/09 by way of satisfying the demands of AFSATU KABBA.

9. That AFSATU KABBA caused the employment of Ibrahim Kabba, her son at the Radiation Protection Unit of the Ministry of Energy and Water Resources without proper employment procedures being followed.

10. That AFSATU KABBA caused the employment of Abdul Wahid Kabba, her son at the Ministry of Fisheries and Marine Resources without proper employment procedures being followed.

11. That AFSATU KABBA caused the employment of Abdul Malik Jobe at the Bumbuna Hydro Eclectic Unit of the Ministry of Energy and Power without proper employment procedures being followed.

12. That PAUL SANDI conspired with AFSATU KABBA and other persons unknown to abuse her office by ordering the employment of ABDUL WAHID KABBA and ABDUL MALIK JOBE respectively at the Ministry of Fisheries and Marine Resources.

13. FRANKLIN CAMPBELL AND BASHIRU KONNEH: will state inter alia that they are Investigators at the Anti Corruption Commission who conducted investigations into the matter. They will also state that they obtained interviewed statements from the suspects AFSATU KABBA and PAUL SANDI and had conduct of the investigations.
